Terms of use
1. Scope
These terms govern your use of the game Heirs — the app for iOS and Android and the online service behind it. Heirs is provided by [PLACEHOLDER: company or legal name] (“we”); our full details are in the Impressum. By creating an account you agree to these terms. Downloading the app and paying for purchases are also governed by the terms of the App Store or Google Play. How we handle your data is described in the privacy policy.
2. The game
In Heirs you lead a house across generations: characters are born, act, age and die, and heirs carry the house on. The game is played online and needs an internet connection and an account. It is free to play; platin can optionally be bought (section 5).
Heirs is developed continuously. We may change, add or remove content, rules and balance to keep the game fair and alive, as long as this is reasonable for you, taking your interests into account. [PLACEHOLDER: legal review of the change clause, in particular for content bought with real money]
We work to keep the game available but cannot promise uninterrupted operation; maintenance, updates or faults can make it temporarily unavailable. The app may ask you to update before you can keep playing.
3. Your account
- You need an email address and a password. While the game is in a limited phase, registration may also require an invitation code.
- [PLACEHOLDER: minimum age, and whether minors need a parent's consent]
- Your account is personal. Keep your password secret and tell us at [PLACEHOLDER: support email address] if you suspect someone else is using your account. Changing or resetting your password signs out every other device.
- One player holds one house at a time; as long as your house has not been razed, the game will not found another one for you.
- You can delete your account at any time; see account deletion.
4. Fair play
You may not:
- use cheats, bots, scripts or other automation, or modified clients, or access the service other than through the app;
- exploit errors in the game instead of reporting them to us;
- attack, overload or probe the service, or try to access other players' accounts or data;
- choose names for your house or your characters that are offensive, discriminatory, impersonate others or infringe the rights of others;
- trade, sell or transfer accounts, houses or game content outside the game;
- [PLACEHOLDER: further rules, e.g. on multiple accounts].
If you break these rules, we may, depending on how serious the breach is, send you a warning, require you to rename your house or a character, or ban the account. We tell you which measure we took and why, and you can contest it at [PLACEHOLDER: contact for appeals]. What happens to platin held by a banned account: [PLACEHOLDER: policy on platin of banned accounts — currently frozen while the ban lasts; refund policy pending legal review].
5. Platin and virtual items
- Gold, items, house platin, bought platin and everything else in the game are virtual. You receive a personal, non-transferable right to use them in the game for as long as your account exists; they have no cash value and cannot be paid out or exchanged for money.
- Platin is bought in packs through the App Store or Google Play, at the price the store shows. The store's payment sheet is the one place a purchase is confirmed; the store's terms and parental controls apply. A purchase waiting for a parent's approval stays pending and credits nothing until it is approved.
- Platin cannot be traded: it cannot be listed at the auction house, sold, given to another player or turned into gold.
- Spending limit. Purchases are limited to €50 in any rolling 30 days unless you change the limit in the app's settings (up to €1,000). Lowering the limit takes effect at once; raising it takes effect 24 hours later.
- Refunds are decided by the store. A refunded pack is taken back in full, even if part of it was already spent, which can take your bought platin below zero. While it is below zero, no platin can be spent and no pack can be bought; if the store reverses the refund, the pack is credited again. What the platin already bought stays bought.
- After a second refund within 12 months, new purchases are put on hold until we have reviewed them. Platin you already hold can still be spent. You can contest the hold at [PLACEHOLDER: contact for appeals].
- Right of withdrawal. [PLACEHOLDER: withdrawal information for digital content — e.g. that the right of withdrawal ends when delivery begins with your express consent and your acknowledgement (§ 18 (1) 11 FAGG / § 356 (5) BGB), how this consent is obtained in the purchase flow, and the model withdrawal form]
- When you delete your account, house platin and bought platin end with it.
6. Liability
[PLACEHOLDER: liability clause under the applicable law — e.g. unlimited liability for intent and gross negligence and for injury to life, body or health; limitation for slight negligence to foreseeable, typical damage from breach of essential obligations; statutory warranty rights for digital content (VGG / §§ 327 ff. BGB) remain unaffected]
7. Ending the contract
You can end the contract at any time by deleting your account. We may end it with [PLACEHOLDER: notice period] notice, or without notice for good cause, in particular a serious or repeated breach of section 4. If we end the game as a whole, we will announce it at least [PLACEHOLDER: notice period for shutting down the game] in advance. [PLACEHOLDER: what happens to unspent bought platin when we end the contract or shut down the game]
8. Changes to these terms
We may change these terms for valid reasons, such as new features or changes in the law. We will tell you about changes in the app at least [PLACEHOLDER: notice period] before they take effect. [PLACEHOLDER: how consent to changes is obtained, and your right to end the contract if you do not agree]
9. Applicable law and disputes
[PLACEHOLDER: governing law, e.g. Austrian law excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods]. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you live. [PLACEHOLDER: place of jurisdiction for disputes with consumers and businesses]
[PLACEHOLDER: whether we are willing or obliged to take part in dispute resolution before a consumer arbitration board, and which one]
10. Contact
